1. Introduction
Welcome to INFINITIX. These Terms of Service ("Terms") govern your use of our website and our software development services. By engaging with our agency, you agree to these terms.
2. Scope of Services
INFINITIX provides custom software development, including web development, web application development, and mobile app development. All project specifics, deliverables, milestones, and deadlines will be outlined in a separate, mutually signed Statement of Work (SOW).
3. Intellectual Property
Upon final payment and completion of the project as outlined in the SOW, all intellectual property rights and source code are transferred to the client. Until final payment is received, INFINITIX retains ownership of all developed materials.
4. Client Responsibilities
The client agrees to provide necessary feedback, assets, and approvals in a timely manner to prevent project delays.
5. Limitation of Liability
INFINITIX is not responsible for downtime, data loss, or server issues related to third-party hosting providers or platforms (e.g., AWS, Apple App Store, Google Play) once the software is deployed.

1. Information Collection
We collect personal information such as name, email, and phone number when submitted via our contact forms to facilitate project discussions and client onboarding.
2. Confidentiality (NDA)
We respect the intellectual property of our clients. All project briefs, source code, and business logic shared with us remain strictly confidential. We are happy to sign a Non-Disclosure Agreement (NDA) prior to any project discussion.
3. Use of Data
We do not sell, rent, or lease customer data to third parties. Information is strictly used for internal project management and client communication.
Refund Policy

1. Milestone-Based Payments
At INFINITIX, our development services are billed on a milestone basis. Due to the custom nature of software and web development, resources and engineering hours are committed immediately upon project commencement.
2. Non-Refundable Deposits
Any initial deposit made to commence the "Discovery & Design" phase is strictly non-refundable once work has begun. This covers the labor of our architects and designers.
3. Mid-Project Cancellations
If a client decides to terminate a project before completion, they will not be billed for future, un-started milestones. However, payments made for fully completed or currently active milestones are non-refundable.
4. Dispute Resolution
If you believe a milestone was not delivered according to the agreed-upon Statement of Work (SOW), please contact us within 14 days of delivery. We will correct the deliverables at no extra cost. If we are fundamentally unable to meet the SOW requirements, a partial refund may be issued at the sole discretion of INFINITIX management.
